Who is affected
Foreign agents and people the Justice Ministry considers obliged to apply for inclusion in the register.
Who is not affected
A report alone is not enough: there must be a final administrative penalty under KoAP 19.34 or a prior conviction under art. 330.1.
What changes
- A criminal case under art. 330.1 is possible after a single administrative penalty under KoAP 19.34 (previously repeated violations were required).
- This covers both failing to file documents for the register (part 1) and breaking the rules for foreign agents (part 2).
What to do now
- If you already have a fine under 19.34, assume the next violation can become a criminal case while you are 'considered penalised'.
- Check labelling and reports with a lawyer, especially after a first fine.
What is not yet clear
How many cases have been opened under the new wording is not published officially.
